Privacy Policy

The mission of ZibdyHealth is to connect the family health and wellness history of everyone in our world. We provide tools to use a person’s own medical history and their family history to manage their health and wellness. This will enable our users and their healthcare providers make better decisions, choices and take preventive measures.

Healthcare information is supposed to be confidential and private but this should not mean inaccessible. We believe that we can accomplish our goal of sharing important alerts within the family and making this information accessible without compromising on the security of personal information.

ZibdyHealth will help you to share your information within your extended family members while helping to protect your privacy.  If you choose, information relevant to family members will be shared with them, based on the permissions you grant.  But the amount and type of information you decide to share, and with whom you share it, is up to you.

ZibdyHealth respects your privacy. This Privacy Policy explains what information we gather via the ZibdyHealth website (“Site”) and ZibdyHealth Services, including the ZibdyHealth Mobile Applications and social network Applications (“Services”), why and how that information may be shared with others, and with whom it may be shared.

We provide the Site and Services to you subject to the terms of this Privacy Policy.  This Privacy Policy is a legally binding agreement between you and ZibdyHealth. By using the Site or Services, you agree to this Privacy Policy and to our Terms and Conditions of Use.

Our Privacy Policy may change from time to time. The Revision Date below will show you when the Privacy Policy was last revised.  By continuing to use the Site or Services, you accept and agree to any revisions to the Privacy Policy.

Application of the Privacy Policy

This Privacy Policy applies solely to the ZibdyHealth Site and Services.  This Privacy Policy does not apply to information collected at any site or on any services not owned by ZibdyHealth, including any third-party website reached through a link on the ZibdyHealth Site or through the Services.  Third-party websites are generally those that have a URL—that is, a web address—that does not contain “zibdy.com.” You are responsible for reviewing and understanding the privacy policies (if any) of third-party websites you access through the ZibdyHealth Site and Services.  We have no control over, and we assume no responsibility for, the content, privacy policies, or practices of any third party website.  By using the ZibdyHealth Site or Services, you release ZibdyHealth from any claim or liability arising from your use of any third party website.

Information We Collect

Personal Information

We collect information that personally identifies you, such as your name, address, phone number, e-mail address, credit card information, and other personally identifiable information that you choose to provide us with or that you choose to include in your ZibdyHealth profile or account (“Personal Information”).  You may be asked to provide us with Personal Information when you register with the Site or use any of our Services, and at other times.  The decision to provide this information is optional.  However, if you choose not to provide the requested information, you may not be able to use some or all of the features of the Site or Services.  In addition, ZibdyHealth offers you the ability to share information with your family, friends, caregivers or medical professionals.  ZibdyHealth may use your information from your contacts to invite your family members to join ZibdyHealth or your network.  ZibdyHealth may therefore receive information about your contacts from your mobile device or other sources.  ZibdyHealth treats this information as your Personal Information.  Further, ZibdyHealth offers location-enabled services, for example to locate a nearby doctor or pharmacy.  If you use those services, ZibdyHealth may receive information about your actual location (such as GPS signals sent by a mobile device) or information that can be used to approximate a location (such as a cell ID).  You will have the option to disable collection and use of location information.  However, doing so may prevent you from using some features of the Services, or limit the function of some features.  Finally, if you refer another user to us, we may collect and retain information you provide to us such as the name and e-mail address of the referred individual.

Personal Health Information

ZibdyHealth permits you to enter a wide range of Personal Health Information on the Site and Services.  Your Personal Health Information is information regarding your medical history, mental or physical condition, or treatment, including, for example, information about your prescriptions, allergies, medical history, diagnoses, and outcomes or side effects of treatments.  ZibdyHealth will not use or disclose your Personal Health Information except as described in this Privacy Policy or with your express authorization.

Personal Health Information of Family Members and Others

ZibdyHealth permits you to enter health and medical information about members of your family, including, for example, their medical history information, prescriptions, allergies, and outcomes and side effects of treatments.  This may enable you to make better decisions and choices about treatments for you or to take preventive measures.  However, you should not upload any personally identifiable health information regarding any person other than yourself without that person’s consent.  YOU MUST OBTAIN THE CONSENT OF YOUR FAMILY MEMBER OR ANY OTHER PERSON BEFORE YOU SUBMIT OR SHARE PERSONAL MEDICAL INFORMATION ABOUT THAT PERSON.  BY SUBMITTING OR SHARING PERSONAL HEALTH INFORMATION ABOUT A FAMILY MEMBER OR ANYONE ELSE, YOU REPRESENT AND WARRANT THAT YOU HAVE OBTAINED THAT PERSON’S EXPRESS CONSENT TO DO SO.

E-Mails Sent to ZibdyHealth

ZibdyHealth provides e-mail addresses to which e-mail messages may be sent for a variety of reasons.  For example, we accept e-mail requests for information about our services, media requests, and questions about this Privacy Policy.  In general, ZibdyHealth uses the information you provide in an e-mail to us only in order to respond to your request.  However, ZibdyHealth makes no promise that any information included in unsolicited e-mails sent to ZibdyHealth or its employees, through this site or otherwise, will be kept confidential.

Usage Data and Site Activity

Like many websites, ZibdyHealth servers monitor and log all web traffic on the Site.  These logs contain the IP address of the computer or server that you are using to access the Site, the IP address and/or the URL from the website you visited just before you visited our Site, the URL of the page you visit upon leaving the Site, if any, and the type of browser and operating system you are using.  Statistical information is collected about visitor traffic patterns in order to improve the quality, functionality and usefulness of the Site to our customers.  This information does not directly identify you. Use of this information is described below.

Cookies and Web Beacons

We may use cookies (a small text file placed on your computer to identify your computer and browser).  We also may use Web beacons (an electronic file placed on a Web site that monitors usage).  We use cookies and Web beacons to improve the experience of the Site and Services, such as pre-populating your username for easier login.  We do not use cookies or Web beacons to collect Personal Information. Instead cookies and Web beacons provide anonymous information that permits ZibdyHealth to track how users navigate our pages, when users return to our sites, and which features are the most popular. We may share that information with other persons or entities who assist us in analyzing or operating the Site.  Most Web browsers are initially set up to accept cookies.  You can reset your Web browser to refuse all cookies or to indicate when a cookie is being sent.  However, certain features of the Site or Services may not work if you delete or disable cookies.

Use of HTML5

HTML is the software language used for building most of the sites on the World Wide Web. Almost all web pages you visit on the Internet are built using HTML code. HTML5 is simply the fifth and latest iteration of this language.  HTML5 is a popular standard for presenting content, especially content delivered to mobile devices.  Some HTML5 code may allow your responses to advertising and other activities to be monitored across websites, and for such information to be stored on your computer or mobile device and accessed by others you do or have done business with.  Solutions that allow users to opt-out of or block this sort of tracking are being developed through browser add-ons and other tools. ZibdyHealth may access user activity information stored through this feature of HTML5.

Information about Use of Advertisements and Links

ZibdyHealth may collect information about your use of third-party advertisements or links to third party websites that are provided on our Site or through our services.  For example, ZibdyHealth may collect information about your responses to advertising on our site, or information about sites you navigate to or access through ZibdyHealth.  ZibdyHealth does not collect or maintain this information in a manner that is personally identifiable to you.  ZibdyHealth may use the information to determine what advertising will be displayed on the Site, or for enhancing the Site.  ZibdyHealth may share this information with advertisers or other third parties.

Like many businesses, ZibdyHealth may also allow other companies to deliver advertisements or links on our Site or through our Applications. These companies may collect and use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) in order to provide advertisements about goods and services likely to be of interest to you.  These companies typically use a cookie or third party web beacon to collect this information.  In addition, if you click on an advertisement you will generally be transferred to a third-party website, and the operator of that website may collection information from you.  To learn more about behavioral advertising or to opt-out of this type of advertising by certain participating advertising networks, you can visit http://www.networkadvertising.org/.  ZibdyHealth is not responsible for the collection or use of information by such marketing companies or third-party websites.

Sharing Your Personal Health Information

A key benefit of using ZibdyHealth is your ability to share your Personal Health Information with family, health care providers and other services to enable you and your healthcare providers to make better decisions, choices and take preventive measures.  You have control over how much of your Personal Health Information you share and with whom you share it, and you can update your Personal Information and Personal Health Information at any time.

  • You can choose to share Personal Health Information with a family member, friend, or caregiver.
  • You can choose to share your Personal Health Information with a health care provider.
  • You may also choose the type of Personal Health Information access you want each recipient to have.
  • You can choose to send your Personal Health Information to other ZibdyHealth Applications.  ZibdyHealth will only send your information to another ZibdyHealth Application if you give your consent.
  • You can choose to send your Personal Health Information to applications or websites outside of ZibdyHealth, such as a website related to a particular disease or a health care entity. However, ZibdyHealth will not send your information directly to any such applications or websites, because ZibdyHealth cannot assure that information you send to a website outside of ZibdyHealth will be private or secure.  Instead, you will need to obtain the information you want to share from your ZibdyHealth account and send it to the website or application outside of ZibdyHealth yourself.  This Privacy Policy does not apply to such third party applications or websites and ZibdyHealth will not be liable for the disclosure or use of information provided to applications, websites and others outside of ZibdyHealth.

Before sharing your Personal Medical Information with others or granting anyone else access to your account, you should be aware that ZibdyHealth does not and cannot control how anyone else may use your information or account.  Personal Medical Information you provide to others may not be protected, kept private, or be secure.  If you allow someone else to have access to your account, they will have access to your Personal Medical Information, and they may share it with others. You are solely responsible for all use of your account, by yourself or anyone whom you permit to use it.  ZibdyHealth will not be liable for any disclosure or use of Personal Medical Information or other information by you or anyone using your account with your permission.

Closing Your Account

If you choose to close your account, ZibdyHealth will offer you a choice to suspend your account indefinitely so that you family can still gain from your health information or ZibdyHealth will permanently destroy its copies of your Personal Health Information according to its data destruction security procedures.  Prior to destroying your information, ZibdyHealth will offer you the opportunity to retrieve or transfer your Personal Health Information.  If you chose to suspend your account, you will have an option to restart it later date and pickup from where you left.

Changing Your Choices

Except for deleting your account, which is permanent, you can change any of the above choices as often as you like.

Accounts for Minor Dependents

Subject to applicable law, parents and guardians may establish accounts for minor dependents (those under the age of 18).  In order to do so, both a parent/guardian and a dependent minor age 13 or older must agree to the conditions under which the contents of the dependent minor’s account are shared with the parent/guardian.  Unless both the parent/guardian and the dependent minor age 13 or older explicitly and specifically consent, ZibdyHealth will not permit sharing or transferring the minor’s information.  In this instance, only the dependent minor may enter information to the ZibdyHealth account. In order to establish an account for a minor 12 and younger, a parent or guardian must provide verifiable parental consent to establishing the account.  Parents/guardians have full access to and control over the accounts of minor dependents age 12 and younger.

How We Share and Use Information

Generally

We will disclose your Personal Information or your or your family members’ Personal Health Information to third parties, including for their direct marketing purposes, only as explained in this Privacy Policy or with your consent.  We may disclose to third parties certain aggregate data regarding the Site and Services, as described in this Privacy Policy.  We may disclose to employers, healthcare plans, or others aggregate information such as the total number of members, employees or beneficiaries using ZibdyHealth or specific tools offered through ZibdyHealth, or the total number of persons using particular medications.  Such aggregate data will not include any Personal Health Information about individually-identifiable users.

We do not rent, sell, or otherwise provide your Personal Information or your or your family members’ Personal Health Information to third parties for their direct marketing purposes without the consent of the person to whom the information pertains.  We will not disclose your Personal Health Information to your employer unless required by law or specifically authorized by you.  In addition, except information added to your account by your health plan, we will not disclose your Personal Health Information to your health plan unless required by law or specifically authorized by you.

We use your Personal Information and your and your family members’ Personal Health Information to provide you with the Site and Services, including to provide you notifications regarding your medications, appointments or condition, and other health information.  We also use your Personal Information for internal purposes such as to improve the Site and Services, to notify you of new products or Services, and to otherwise communicate with you about ZibdyHealth.

We may use your and your family members’ Personal Health Information to provide you information about additional services or therapies from third-parties.  We will obtain your authorization to use Personal Health Information in this manner.

Service Providers

From time to time, we may establish a business relationship with other businesses to provide services on our behalf (“Service Providers”).  For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, data storage and management, and marketing and promotions.  We only provide our Service Providers with the information necessary for them to perform these services on our behalf.  Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information and Personal Health Information from unauthorized access, use or disclosure.  Service Providers are required to maintain the confidentiality of your Personal Information and Personal Health Information and are prohibited from using it other than as specified by ZibdyHealth.

Aggregate Data

We may aggregate data from multiple records containing personally identifiable records in a manner that is no longer identifiable with a particular person (for example, the aggregate number of inquiries from a particular city, state or zip code).  We may share aggregate data, Usage Data and Site Activity Data (described above) with contractors, consultants, advertisers, analysis, government authorities, and other third parties.

Legal Requests and Harm Prevention

We may disclose information pursuant to subpoenas, court orders, or other requests if we have a good faith belief that the response is required by law.  We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, to address security or technical issues, to protect ZibdyHealth’s legal interests, or to enforce ZibdyHealth’s Terms of Service, including the investigation of potential violations.  In response to a court order, subpoena, or other legal process, we may also disclose the content of logs (described above) containing the IP address of the computer or server that you are using to access the Site, the IP address and/or the URL from the website you visited just before you visited our Site, the URL of the page you visit upon leaving the Site, if any, and the type of browser and operating system you are using.

Security

We implement and maintain reasonable security procedures and practices appropriate to the nature of the information we collect in an effort to protect your information from unauthorized access, destruction, use, modification, or disclosure. In particular:

  • In order to help secure your personal information, access to your data on ZibdyHealth is password-protected, and all data is protected by SSL encryption when it is exchanged between your web browser and/or mobile device and the ZibdyHealth website.
  • We offer you two step verification when you access your ZibdyHealth Account from your web browser and/or mobile device.
  • We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems.

Unfortunately, however, no data transmission over the Internet can be guaranteed 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to or from our Site and Services, and you do so at your own risk. ACCORDINGLY, WE DISCLAIM LIABILITY FOR ANY THEFT, LOSS, OR INTERCEPTION OF OR ANY UNAUTHORIZED ACCESS OR DAMAGE TO ANY DATA OR COMMUNICATIONS. BY USING THE SITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.

Transfer in the Event of Sale or Change of Control

If ZibdyHealth is involved in a merger, acquisition or asset sale, we may transfer your information to a new owner so that the services we provide you can continue to operate.  In such a case, we will give you notice before personal information is transferred or becomes subject to a different privacy policy.

Consent to International Data Processing

This Site is operated in the United States. By providing any information to ZibdyHealth, all users, including, without limitation, users in the member states of the European Union, Canada or elsewhere outside of the United States, represent that they fully understand and consent to this Privacy Policy.  ZibdyHealth may transfer your personal information to our contractors located in the United States and other countries for the purposes and under the conditions described in this Privacy Policy.  By using our Site or Services, and/or providing us with your information, you consent to the collection, transfer, storage and processing of your information to and in the United States or any other country in the world. In addition, you waive any restrictions on such collection, transfer, or storage of your information imposed by the laws of any country other than the United States.

Changes to this Privacy Policy

We reserve the right, in our sole discretion, to add to, change, update or modify this Privacy Policy, in whole or in part, at any time.  When we amend this Privacy Policy, we will revise the effective date located at the beginning of this Privacy Policy. For changes to this Privacy Policy that we consider to be material, we will place a notice on the ZibdyHealth website by revising the link on the homepage to read substantially as “UPDATED Privacy Policy” for a reasonable amount of time, and by sending notice to the email address associated with your account.  If you use a mobile device to access ZibdyHealth, we will provide a notification through the ZibdyHealth mobile application.  If you object to any changes, you may close your account.  By providing information to us or using the Site or Services in any way after this Privacy Policy has been revised, you consent and agree to the revised Privacy Policy.  The most current version of this Privacy Policy will be available on the Site and through the Services and will supersede all previous versions of this Privacy Policy.  The effective date of the current version of this Privacy Policy is listed at the beginning of the Privacy Policy.

Conditions of Use

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, United States of America.  By using our Site or Services, you consent to the collection and use of information described above.  Your visit to the Site or Services and any dispute over privacy are subject to this Privacy Policy and to our Terms and Conditions of Use (including the provisions requiring arbitration of disputes).
